ORDINANCE NO. 8848

 

AN ORDINANCE OF THE CITY OF LAWRENCE, KANSAS PROVIDING FOR THE DEDICATION OF PUBLIC RIGHT-OF-WAY ON THE EAST SIDE OF PARK WEST SUBDIVISION AND GLENWOOD ADDITION NO. 2, ADDITIONS TO THE CITY OF LAWRENCE, DOUGLAS COUNTY, KANSAS

 

 

 

 

 

 

WHEREAS, The City of Lawrence, Kansas (City), is the Owner of Record of the following described real estate situated in Lawrence, Douglas County, Kansas to-wit:

 

A tract of land in the Southwest Quarter of Section 28, Township 12 South, Range 19 East of the 6th P.M. in the City of Lawrence, Douglas County, Kansas, more particularly described as follows:

 

Beginning at a point on the North line of the Southwest Quarter of said Section 28 at the Northwest corner of a tract conveyed to the City of Lawrence recorded in book 534 on page 837 at the Douglas County Register of Deeds said Point of Beginning being on the East line of Park West a Subdivision in the said City of Lawrence and the Southwest corner of Lot 11 in Glenwood Addition No. 2, a Subdivision in the said City of Lawrence; thence along the East line of said Park West Subdivision, being the East right-of-way line of Eisenhower Drive a public street in said Park West Subdivision and along the East line of Lot 1, Block 5 in said Park West Subdivision S.1°58'53"E. 480.90 feet; thence N.88°01'07"E. 10.00 feet; thence parallel to and 10.00 feet Easterly of (measured perpendicular to) the East line of said Park West Subdivision N.1°58'53"W. 480.87 feet to a point on the North line of the Southwest Quarter of said Section 28, and the South line of Lot 11 in said Glenwood Addition No. 2; thence along the North line of the Southwest Quarter of said Section 28, and the South line of Lot 11 in said Glenwood Addition No. 2 S.88°13'57"W. 10.00 feet to the Point of Beginning.

 

Bearings herein are based on the bearings indicated on The Park West Subdivision and Glenwood Addition No. 2.

 

This easement contains 0.110 acres.  (Exhibit A – see attached)

 

WHEREAS, City intends, and by this ordinance does, hereby order the dedication of the above described real estate as public right-of-way, to be used for such purposes as provided by the laws of the State of Kansas and City;

 

WHEREAS, upon the adoption of this ordinance and its publication according to law, City shall cause to be made, executed, acknowledged and filed with the Office of the Register of Deeds the dedication of the above-described real estate as Public Right-of-Way.

 

NOW THEREFORE BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF LAWRENCE, KANSAS.

 

SECTION I.  That following the passage and publication of this ordinance City shall cause to be made, executed, acknowledged and filed with the Office of the Register of Deeds, Douglas County, Kansas, the dedication of the above-described real estate as Public Right-of-Way.

 

SECTION II. This ordinance shall take effect and be in full force upon its passage and publication in the official City newspaper.
