Award the construction contract for Bid No. B1305 to the low bidder, Garney Construction, in the amount of $1,967,967.00, authorize the City Manager to execute the construction contract, and authorize the City Manager to execute Supplemental Agreement No. 2 with Wilson and Company in the amount of $33,800.00 for construction phase engineering services for project UT1206DS O’Connell Road Waterline
Project Description
The O’Connell Road Waterline project involves the installation of approximately 9,200 lineal feet of 16” waterline, 970 lineal feet of 12” waterline, 6,800 lineal feet of 4” waterline, and construction of a metering station providing points of connection for the City of Baldwin and Douglas County Rural Water District No. 4. Installation of the 12” and 16” watermain will commence at O’Connell Road and Prairie Terrace, at the limit of the existing distribution system, and continue south to approximately 2,000 feet north of 1100 Road as shown on the attached map. The project also includes the replacement of an existing Rural Water District No. 4 8” waterline with a 4” waterline as shown on the attached map.
Project History
Department of Utilities staff have been coordinating with KDOT, HNTB, City of Baldwin, Rural Water District No. 4, and Wilson and Company for utility relocations required for the construction of the completion of the South Lawrence Trafficway. Both the City of Baldwin and Douglas County Rural Water District No. 4 currently have their metered connection points in the vicinity of the intersection of 31st Street and Haskell Avenue and must relocate their meter and backflow vaults to accommodate the planned reconstruction of this intersection as part of the South Lawrence Trafficway project.
Department of Utilities staff have been coordinating with KDOT, RWD#4, City of Baldwin, and Wilson and Company on the O’Connell Watermain Extension to complete design and bid the project in early 2013 so construction will be completed in accordance with KDOT’s bidding and construction schedule for the South Lawrence Trafficway.
Project Status/ Details
Wilson and Company completed construction documents for the project and it was advertised for bidding on February 06, 2013. Bids were opened March 05, 2013 and the bids listed below read publicly aloud.
Garney Construction: $1,967,967.00
Emerson Construction Inc.: $2,129,000.00
Nowak Construction: $2,134,660.50
Engineers Estimate: $2,409,923.00
Wilson & Company has reviewed the bids and qualifications of the low bidder and, per the attached letter and bid tabulation, recommend awarding the bid to the low bidder Garney Construction.
Department of Utilities staff have negotiated a construction phase engineering services agreement in the amount of $33,800.00. The fee negotiated represents 1.7% of the low bid construction cost. The negotiated scope and fee includes submittal review, project coordination, and milestone inspection services. These services are in support of Department of Utilities Engineering Staff daily inspection and construction administration activities.
The table below reflects the proposed fee components in relation to the low bid construction costs.

The total ESA as a percentage of construction cost at 9.87% falls above the percentage as interpolated from the adopted design fee guideline of 7.63%. This is due to the inclusion of services above and beyond the scope of basic A/E design services including property acquisition, land use requirements, geotechnical investigations, bid phase, and construction phase services.
Anticipated Project Schedule
Notice to Proceed April 08, 2013
Project Completion July 17, 2013 (Substantial)
Project Completion August 16, 2013 (Final)
Contract time for the project is 100 calendar days to attain substantial completion and 130 calendar days to final completion.
Project Funding
Funding for the project will be from the Department of Utilities non-bonded construction fund. Cost sharing agreements with KDOT, City of Baldwin, and Rural Water District No. 4 have been finalized and the City will be reimbursed a lump sum amount of $1,094,461.00 per the executed utility agreement with KDOT.

Award the construction contract for Bid No. B1305 to the low bidder, Garney Construction, in the amount of $1,967,967.00, authorize the City Manager to execute the construction contract, and authorize the City Manager to execute Supplemental Agreement No. 2 with Wilson and Company in the amount of $33,800.00 for construction phase engineering services for project UT1206DS O’Connell Road Waterline
