Recommendations/Options/Action Requested:

 

Conduct the public hearing regarding the dilapidated principal structure (single-family detached house) and accessory structure (shed) located at 1512 Oak Hill Avenue.  Staff recommends that the City Commission adopt Resolution No. 7239 declaring the structures as unsafe and dangerous structures, and directing staff to demolish and remove the structures if the owner fails to substantially repair or demolish and remove the structures by March 30, 2018, with the incurred costs and expenses to be assessed against the property.

 

Executive Summary:

On January 16, 2018, the City Commission adopted Resolution No. 7236, which set a public hearing date of March 6, 2018 to hear testimony, at which time any person having any interest in the property may appear and show cause why the structures should not be condemned as unsafe and dangerous structures and ordered repaired or demolished. 

 

At that time, Staff provided a memorandum (attached) that provided a summary of Staff’s efforts to facilitate a plan of action with the Ronald E. Stalkfleet, to bring the property into compliance with city code.

 

Update since the adoption of Resolution No. 7236

On February 20, 2018, Staff spoke to Kay Sheaffer, the significant other of Ronald E. Stalkfleet. Ms. Sheaffer advised that they plan to submit a demolition permit within a week as they wish to demolish the structures rather than the City pursuing the demolition.  Staff advised Ms. Sheaffer that the public hearing would continue to be held on March 6, 2018 and any new information such as a demolition permit submittal would be shared with the City Commission for their consideration.

Fiscal Impact (Amount/Source):

The fiscal impact to the City would be the cost incurred for the City to demolish and remove the structures, which would be determined through a bid process.   A lien would then be assessed against the property in accordance with K.S.A. 40-3901 et. seq.
