Recommendations/Options/Action Requested:

 

Authorize the Mayor to execute a temporary construction easement authorizing the grading of Block B Lot 2 and certain improvements to the drainage tract of Lawrence VenturePark for the VanTrust project.

 

Executive Summary:

In 2017, the City of Lawrence entered into an agreement with VanTrust Real Estate concerning the development of three phases of speculative development in Lawrence VenturePark.  The first phase is to occur on Block B Lot 1 and the second phase on Block B Lot 2, adjacent to the east of Block B Lot 1.

 

Under the terms of the development agreement with VanTrust, upon pulling a building permit and satisfying the other contingencies associated with the Phase 1, the Block B Lot 1 property will be transferred to VanTrust.  VanTrust has requested that the City allow a temporary construction easement on Block B Lot 2, which would be the future site of Phase 2.  The purpose of the temporary construction easement is to enable VanTrust to complete the grading for Lot 1 and Lot 2 at the same time.  The grading on Lot 2 would be done entirely at VanTrust’s risk.  Even if VanTrust development eventually does not proceed on Lot 2, the City will have a graded lot, which appears to be more advantageous than an ungraded lot.  Thus, staff recommends approval of the temporary construction easement and that the City provide permission to allow grading on Lot 2, though it will still remain in the City’s ownership until VanTrust is in a position to pull a building permit and satisfy the other necessary contingencies associated with Phase 2 on Lot 2.    There are also some other minor work to be undertaken on the drainage tract, which is east of Lot 2.  KCI Lawrence 153, LLC is the entity that VanTrust has created for the project in Lawrence. 

 

Should the easement be authorized, it will be executed at the time of closing of Lot 1.  Closing date is to be scheduled very soon.
