Conduct a public hearing; find that the proximity of the sale of cereal malt beverages by Archibowls at 125 E. 10th Street is not adverse to the public welfare or safety and grant a distance limitation waiver, if appropriate.

 

Executive Summary:

Archibowls is seeking a Cereal Malt Beverage License at 125 E. 10th Street. This location is within 400’ of The Greenhouse Culture, a church, located at 1001 Massachusetts Street and The Salvation Army, a church, located at 946 New Hampshire Street. The City Code prohibits the sale of cereal malt beverages within 400’ of a school or church, unless the following steps are taken:

  • The affected churches or schools are given notice of a public hearing to consider a distance limitation waiver;
  • A public hearing is held before the City Commission;
  • The City Commission finds that the proximity of the sale of cereal malt beverages are not adverse to the public welfare or safety; and
  • The City Commission grants a distance limitation waiver (section 4-206 of the City Code).

 

City staff has notified The Greenhouse Culture and The Salvation Army that there will be a public hearing on March 20th regarding issuance of the proposed Cereal Malt Beverage License.
