Initiate a Text Amendment, TA-18-00154, to the City of Lawrence Land Development Code, Article 13 to review and potentially remove the ability to condition zoning. |

Executive Summary: |
On March 20, 2018, the City Commission considered a rezoning request (Z-17-00689) that included conditions. At that meeting, the Commission disfavored the use of conditional zoning and directed staff to review the use with the intent of removing conditional zoning from the Land Development Code.
The use of conditional zoning was specifically added to the Land development Code in 2006. This created a tool for land use entitlements to be facilitated when there is a need to balance conflicting needs. There has been past discussions of the legality and use of conditional zoning in Lawrence (see attachments below for more context).
If initiated staff will provide a full review and analysis of conditional zoning, as well as the concepts of spot zoning and contract zoning, specific code language will be modified and submitted to the Planning Commission for a recommendation with a final decision being made by the City Commission at a future meeting.
