Authorize the acceptance of donation from WE1929, LLC of the remainder of Block 1, Tract A (.671 acres), Fox Chase East Addition, to the City of Lawrence as park land/open space. |

Executive Summary: |
Developers of Cedar Grove Subdivision approached the department regarding Block 1, Tract A, Fox Chase East Addition as a donation for parkland/open space to the City of Lawrence. The City has an interest in the tract, as it is an extension of DeVictor Park, providing additional green space. A portion of this tract was deeded to the City in January 2001. The remaining portion will provide connectivity to DeVictor Park from Legends Drive and the soon to be platted Cedar Grove Subdivision. Tract A was noted on the original plat for Fox Chase East Addition as being reserved for future greenbelt and pedestrian connection to Legends Drive. The area of this tract is encumbered by a 66’ natural gas line easement. An encroachment agreement was recorded between the City and the gas line owners in 2001 to allow for street, sidewalk and other improvements to be installed in the gas line easement.
The final plat of Cedar Grove Subdivision was accepted by the Governing Body on the February 6, 2018 agenda. This plat provides pedestrian connectivity at the end of Juniper Lane to Tract A and DeVictor Park.

Fiscal Impact: |
A City Attorney’s Office review of the tract has found no title issues to the property and taxes have been paid. There is a title commitment and a warranty deed has been executed to the City that will be filed after City Commission acceptance of the tract as parkland/open space. |
