Recommendations/Options/Action Requested:

 

Conduct a public hearing regarding distance limitation waiver request for the 2018 Hot Rod Hullabaloo Hevent to be held Saturday, September 22, 2018 on Massachusetts Street between 11th Street and South Park Street from 10:00 a.m. to 3:30 p.m.

 

Find that the proximity of the temporary sale of alcoholic liquor for the event is not adverse to the public welfare or safety and grant a distance limitation waiver.

 

Adopt on first reading Ordinance No. 9453, allowing the sale, possession, and consumption of alcohol on the public right-of-way on Saturday, September 22, 2018 on Massachusetts Street between 11th Street and South Park Street from 10:00 a.m. to 3:30 p.m. associated with the Hot Rod Hullabaloo event.

 

 

Executive Summary:

The Hot Rod Hullabaloo event organizers have applied for street event temporary use of right-of-way permit for their 2018 event, which will be held on Saturday, September 22, 2018 from 10:00 a.m. to 3:30 p.m. in South Park. The event will include the closure of Massachusetts Street between 11th Street and South Park Street from 5:00 a.m. to 6:00 p.m..

 

The Event applicant has requested an ordinance authorizing the sale, possession, and consumption of alcohol on Massachusetts Street between 11th Street and South Park Street during their event.

 

The request to sell, possess, and consume alcohol within the public right-of-way has been reviewed pursuant to City of Lawrence Code, Chapter IV, Article 1, Section 4-113 and was found to be within 400 feet of a church or school. Pursuant to code requirements, staff has notified the churches on March 15, 2018 that a public hearing regarding this request will be held on April 17, 2018 at the City Commission Meeting (See attached letter).
