Consider adopting on second and final reading, Ordinance No. 9324, pertaining to a Community Police Review Board. 

 

Executive Summary:

At its May 1, 2018 meeting, the City Commission considered a draft of Ordinance 9324, which would amend Chapter 1, Article 25 of the City Code by establishing a Community Police Review Board. At that meeting the City Commission directed staff to add additional language to the Ordinance. The following items have been incorporated into the current draft:

 

Section 1-2503 (Definitions): Added additional protected classes to the definition of Racial or Other Bias-Based Policing.

 

Section 1-2504 (Specific Duties of the Board): Added language requiring the Board to accept a written statement from the complainant during its review of an appeal; added language related to the Board reviewing the entire Office of Professional Accountability internal investigation file; changed references to “closed” session to “executive session” for consistency; added a standard of review for the Board to use during its consideration of an appeal; added language requiring the City Manager to consider the Board’s recommendation, rather than having the option to; added language regarding the City Manager’s review of the Board’s recommendation.

 

Section 1-2506 (Qualifications): Added language regarding training and requiring the City Manager to report to the City Commission each year on that training, including the type and length of each.

 

Section 1-2512 (Retaliation Prohibited): Added a new section prohibiting retaliation against a complainant, witness, or police officer involved in the filing of a Complaint or appeal.  

 

Regarding a question that the Commission posed to staff related to best practices for qualifications, staff reached out to the International Association of Chiefs of Police, the International Municipal Lawyers Association, and the League of Kansas Municipalities after the May 1 meeting and learned that neither entity has a model policy or best practices document. Staff will continue to research this question ahead of the next meeting.
