Recommendations/Options/Action Requested:

 

Conduct a public hearing regarding distance limitation waiver request for the 2018 Live on Mass #1 event to be held Friday, June 29, 2018 from 6:00 p.m. to 11:30 p.m. in the 1000 block of Massachusetts Street.

 

Find that the proximity of the temporary sale of alcoholic liquor for the event is not adverse to the public welfare or safety and grant a distance limitation waiver.

 

Adopt on first reading Ordinance No. 9461, allowing the sale, possession, and consumption of alcohol on the public right-of-way on Friday, June 29, 2018 in the 1000 block of Massachusetts Street for the Live on Mass #1 event.

 

Executive Summary:

The Live on Mass event organizers have applied for a street event temporary use of right-of-way permit for their 2018 event which will be held on Friday, June 29, 2018. The event will include the closure of the 1000 block of Massachusetts Street for the event.

 

The event applicant has requested an ordinance authorizing the sale, possession, and consumption of alcohol in the 1000 block of Massachusetts Street for the event.

 

The request to sell, possess, and consume alcohol within the public right-of-way has been reviewed pursuant to City of Lawrence Code, Chapter IV, Article 1, Section 4-113 and was found to be within 400 feet of a church or school. Pursuant to code requirements, staff notified the church on April 10, 2018 that a public hearing regarding this request would be held on May 15, 2018 at the City Commission Meeting. The affected area for this event is the 1000 block of Massachusetts Street.

 

This event request has been reviewed by Parks and Recreation, Public Works, Police, Fire/Medical, Downtown Lawrence Inc., Lawrence Transit, Explore Lawrence, and Lawrence Association of Neighborhoods and was completed with no issues being identified.
