Adopt on first reading, Ordinance No. 9478, amending the City’s Alcoholic Beverage and Cereal Malt Beverage Code in order to come into compliance with amendments to State law, if appropriate. |

Executive Summary: |
The Kansas legislature, through the enactment of House Bill No. 2470, amended the state liquor laws to permit licensed premises in the State to sell and serve alcoholic liquor between the hours of 6:00 a.m. and 2:00 a.m. The proposed amendment to Section 4-109 of the City Code would bring the City into compliance with that amendment to State law. Also, there was a recent ruling in Douglas County District Court that, in order to prosecute a person for operating in the City without a license, the City Code must require that the person not only obtain a license from the City but have an existing valid City license. The proposed amendments to Section 4-106 and Section 4-204 brings both the City’s Alcoholic Beverage Code and the Cereal Malt Beverage Code into compliance with that decision. |
