SPECIAL USE PERMIT NO. SUP-17-00697
AN ORDINANCE OF THE CITY OF LAWRENCE, KANSAS, GRANTING A SPECIAL USE PERMIT FOR EXTENDED CARE FACILITY, GENERAL USE ON THAT REAL PROPERTY, COMMONLY KNOWN AS 1701 RESEARCH PARK DRIVE, AND THAT REAL PROPERTY LOCATED, GENERALLY, NEAR THE INTERSECTION OF RESEARCH PARK DRIVE AND WEST 18TH STREET, LAWRENCE, DOUGLAS COUNTY, KANSAS.
BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF LAWRENCE, KANSAS:
SECTION 1. In accordance with City of Lawrence, Kan., Code §§ 20-1306 and 20-1307(c)(2) (Jan. 1, 2018), as amended, the Governing Body of the City of Lawrence, Kansas, hereby grants to the owner/applicant Special Use Permit, No. SUP-17-00697, for that real property, commonly known as 1701 Research Park Drive, and that real property located, generally, near the intersection of Research Park Drive and West 18th Street, Lawrence, Douglas County, Kansas, and bearing the following legal description, to-wit:
LOT 1, OREAD WEST NO. 16, IN THE CITY OF LAWRENCE, DOUGLAS COUNTY, KANSAS
and an unplatted tract described as:
a tract of land in the northwest quarter of section 4, township 13 south, range 19 east of the sixth principal meridian, in the city of lawrence, douglas county, kansas, described as follows: beginning at the northeast corner of lot b, of a lot split for lots 5, 6 and 7, block one, foxfire addition no. 4, a subdivision in the city of lawrence, douglas county, kansas; thence south 01°39’44” east, along the east line of said lot b, 236.85 feet to the southeast corner of said lot b; thence north 89°17’43” east, 316.76 feet to the west right-of-way line of research park drive; thence north 00°42’17” west, along said west right-of-way line, 236.82 feet; thence south 89°17’43” west, 320.72 feet to the point of beginning.
permitting that real property to have that special use set forth in Section 2, infra, subject to the conditions established in Section 3, infra.
SECTION 2. The City hereafter permits the subject real property, as granted in Section 1, supra, in accordance with Special Use Permit, No. SUP-17-00697, to have the following special use: Extended Care Facility, General.
SECTION 3. The Special Use Permit granted in Section 1, supra, and the permitted special use described in Section 2, supra, are subject to the general conditions established in Chapter 20 of the Code of the City of Lawrence, Kansas, 2015 Edition, as amended, and is also subject to the following conditions:
(a) Prior to release of the accompanying site plan for building permits, the applicant shall provide a photometric plan to the Planning Office for review to ensure compliance with Section 20-1103 of the City Code, and amendments thereto.
(b) Approval by the Stormwater Engineer of a best management practice for stormwater drainage at the west end of the proposed parking lot to mitigate the effect of parking that exceeds parking code requirements.
SECTION 4. Failure of the applicant, owner, or any successor or assign to abide by the requirements of Chapter 20 of the Code of the City of Lawrence, Kansas, 2018 Edition, as amended, or the special conditions established in Section 3, supra, shall be cause for the City to revoke Special Use Permit, No. SUP-17-00697, in accordance with City of Lawrence, Kan., Code § 20-1605 (Jan. 1, 2018), as amended.
SECTION 5. If any section, sentence, clause, or phrase of this ordinance is found to be unconstitutional or is otherwise held invalid by any court of competent jurisdiction, it shall not affect the validity of any remaining parts of this ordinance.
SECTION 6. This ordinance shall be in full force and effect from and after its passage and publication as provided by law.
