ORDINANCE NO. 9486

 

AN ORDINANCE OF THE CITY OF LAWRENCE, KANSAS, AMENDING CHAPTER 1, ARTICLE 4, SECTION 1-405, OF THE CODE OF THE CITY OF LAWRENCE, KANSAS, 2018 EDITION AND AMENDMENTS THERETO, PERTAINING TO THE OFFICERS AND EMPLOYEES OF THE CITY OF LAWRENCE, KANSAS, AND REPEALING EXISTING SECTION 1-405.

 

BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF LAWRENCE, KANSAS:

 

SECTION 1. Chapter 1, Article 4, Section 1-405, of the Code of the City of Lawrence, Kansas 2018 Edition and amendments thereto, is hereby amended to read as follows:

 

1-405               RESIDENCY REQUIREMENTS FOR CERTAIN CITY EMPLOYEES.

 

(A)       The following City employees are hereby required to establish and maintain a permanent residence within the incorporated boundaries of the City of Lawrence, Kansas for the positions of: City Manager, Assistant City Manager(s) and all department directors, including, but not limited to the following positions: Assistant City Manager- Administrative Services, Assistant City Manager - Community Development Services, Chief of the Lawrence Police Department, Director of Public Works the Municipal Services and Operations Department, Director of Administrative Services/City Clerk, Fire & Medical Chief of the Lawrence-Douglas County Fire Medical Department, Director of Neighborhood Resources, Director of Finance/City Treasurer, Director of Human Relations/Human Resources, Director of Information TechnologyServices, Director of Parks and Recreation, Director of the City Attorney’s Office, and the Director of Planning and Development Services., and Director of Utilities.

 

(B)       Employees as described in subsection (A) of this section who are not already residents of the City of Lawrence at the inception of their employment with the City shall have a period of six (6) months after such employment begins within which to establish residence within the City, after the end of such six (6) months period their exemption from the requirements of this Section shall terminate.

 

(C)       Violation of any of the provisions of this Section shall result in discharge from employment with the City. (Ord. 6267)

 

SECTION 2. Existing Chapter 1, Article 4, Section 1-405, of the Code of the City of Lawrence, Kansas, 2018 Edition, and amendments thereto, is hereby repealed in its entirety, it being the intent of the Governing Body that this ordinance supersede the repealed Code section.

 

SECTION 3. If any section, sentence, clause, or phrase of this ordinance is found to be unconstitutional or is otherwise held invalid by any court of competent jurisdiction, it shall not affect the validity of any remaining parts of this ordinance. 

 

SECTION 4. After passage, approval, and publication, as provided by law, this ordinance shall be in full force and effect commencing January 1, 2019.
