Recommendations/Options/Action Requested:
Receive Request for Annexation No. A-18-00246 and refer the request to the Lawrence-Douglas County Planning Commission for consideration and recommendation and authorize the City Manager to give statutory notice to Rural Water District No. 1 and to Westar Energy of the City’s intent to annex the subject property.
Executive Summary:		DFC Company of Lawrence, L.C., the owner of record of approximately 34.2 acres located west of Hunters Drive and Hill Song Circle (“the subject property”), has petitioned the City, by filing Request for Annexation, No. A-18-00246, to annex the subject property to facilitate future residential development on the subject property. Since the subject property adjoins the City limits and the owner of record has, by filing Request for Annexation, No. A-18-00246, petitioned the City for annexation, the City may, under K.S.A.  2017 Supp. 12-520(a)(7), annex the subject property. Pursuant to City policy, the City Commission refers requests for annexation, where the area of the property to be annexed exceeds 10 acres, to the Lawrence-Douglas County Metropolitan Planning Commission for consideration and recommendation. The area of the subject property exceeds 10 acres. Additionally, because the subject property is located in the certified territory of Rural Water District No. 1, before the City may annex the subject property, the City must provide written notice to Rural Water District No. 1 under K.S.A. 2017 Supp. 12-539. Also, because the subject property is in the certified territory of Westar Energy, Inc., before the City may annex the subject property, the City must provide written notice to Westar under K.S.A. 2017 Supp. 66-1,176. It should be noted that giving notice of intent to annex the subject property does not obligate the City to annex the subject property. In summary, at this time, the City Commission will not take any final action on Request for Annexation, No. A-18-00246. Rather, the City Commission will receive the Request for Annexation and, if appropriate, refer the request to the Planning Commission for consideration and recommendation and authorize the City Manager to give statutory notice to Rural Water District No. 1 and to Westar Energy of the City’s intent to annex the subject property.
