ORDINANCE NO. 9484

 

AN ORDINANCE OF THE CITY OF LAWRENCE, KANSAS, ENACTING CHAPTER 1, ARTICLE 4B OF THE CODE OF THE CITY OF LAWRENCE, KANSAS 2018 EDITION AND AMENDMENTS THERETO, PERTAINING TO THE DEPARTMENT OF MUNICIPAL SERVICES AND OPERATIONS FOR THE CITY OF LAWRENCE, KANSAS.

 

WHEREAS, Pursuant to Chapter 1, Section 1-212 of the Code of the City of Lawrence, Kansas, 2018 edition and amendments thereto, the Governing Body has the authority to create  administrative departments within the City, as the public business may demand and as provided by state law;

 

WHEREAS, on April 10, 2018 the Governing Body expressed support for the City Manager to merge the Department of Public Works and the Department of Utilities to create a new administrative department to be known as the Department of Municipal Services and Operations;

 

WHEREAS, on June 19, 2018, the Governing Body considered and passed various ordinances merging the duties of the Department of Public Works and the Department of Utilities into the Department of Municipal Services and Operations Department; and

 

WHEREAS, it is the intent of the Governing Body hereby to create and to establish the Department of Municipal Services and Operations for the City of Lawrence, Kansas, to be headed by a Director, who shall be appointed by and shall serve at the pleasure of the City Manager and who shall have the attendant duties, authority, and responsibilities as set forth herein.

 

NOW, THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF LAWRENCE, KANSAS:

 

SECTION 1.  Chapter 1, Article 4B of the Code of the City of Lawrence, Kansas 2018 edition and amendments thereto is hereby created to read as follows.

 

ARTICLE 4B.  DEPARTMENT OF MUNICIPAL SERVICES AND OPERATIONS

 

1-4B01            MUNICIPAL SERVICES AND OPERATIONS DEPARTMENT.

Pursuant to the laws of the State of Kansas and the City of Lawrence, Kansas, the Governing Body hereby creates and establishes, as an administrative department of the City, the Department of Municipal Services and Operations to be charged with such duties, authority, and responsibilities as may be determined by the City Manager.

 

1-4B02            DIRECTOR; AUTHORITY.

The Department of Municipal Services and Operations shall be headed by a Director, who shall be appointed by and shall serve at the pleasure of the City Manager. The Director shall be responsible for the proper organization, training, discipline, and the day-to-day functioning of the Department of Municipal Services and Operations. The Director shall be answerable to the City Manager and shall take direction from the City Manager.

 

 

1-4B03            PERSONNEL.

The Department of Municipal Services and Operations shall consist of the following employees:

 

(a)        Director of the Department of Municipal Services and Operations.

 

(b)        Such other employees that may be required by statute or ordinance or that may be deemed necessary by the City Manager to effectively carry out the work of the department.

 

1-4B04            CAPACITY.

The Department of Municipal Services and Operations shall be an unincorporated department of the City, shall not have the capacity to sue or be sued, and shall not have the capacity to enter into contracts in its own name.

 

SECTION 2. This ordinance shall take effect and be in force after its passage and publication as provided by law.
