Recommendations/Options/Action Requested:
Hold a public hearing; find that the proximity of the sale of alcohol by Basil Leaf Café at 616 W. 9^th Street is not adverse to the public welfare or safety and grant a distance limitation waiver, if appropriate.
Executive Summary:		Basil Leaf Café, 616 W. 9^th Street, received a distance limitation waiver on July 23, 2013. The business is undergoing a change in ownership which requires issuance of new State and City liquor licenses. The current distance limitation waiver allowing the sale of alcohol is non-transferrable, therefore a new waiver must be granted. City Code requires the following step be taken before granting the waiver: The affected churches or schools are given notice of a public hearing to consider a distance limitation waiver; A public hearing is held before the City Commission; The City Commission finds that the proximity of the sale of cereal malt beverages are not adverse to the public welfare or safety; and The City Commission grants a distance limitation waiver (section 4-206 of the City Code). City staff has notified the affected church that there will be a public hearing on September 4^th regarding issuance of a distance limitation waiver. To date, staff has received no objections to the issuance of the license.
