Recommendations/Options/Action Requested:

 

Conduct a public hearing regarding distance limitation waiver request for the Lawrence Arts Center’s Fall Fundraiser event being held on Saturday, October 20, 2018 from 12:00 p.m. to 11:30 p.m. The public hearing would apply to the 900 block of New Hampshire Street.

 

Find that the proximity of the temporary sale of alcoholic liquor for the event is not adverse to the public welfare or safety and grant a distance limitation waiver.

 

Adopt on first reading Ordinance No. 9556, allowing the sale, possession, and consumption of alcohol on the public right-of-way in the 900 block of New Hampshire Street on Saturday, October 20, 2018 from 12:00 p.m. to 11:30 p.m. during the event.

 

 

Executive Summary:

The Lawrence Arts Center has applied for a street event temporary use of right-of-way permit for their 2018 event (BLOCKTOBERFEST), which will be held Saturday, October 20, 2018 from 12:00 p.m. to 11:30 p.m.

 

The event will close the 900 block of New Hampshire Street.

 

The request to sell, possess, and consume alcohol within the public right-of-way has been reviewed pursuant to City of Lawrence Code, Chapter IV, Article 1, Section 4-113. The event was found to be within 400 feet of a church or school. Pursuant to code requirements, staff has notified the church on July 31, 2018 that a public hearing regarding this request will be held on Tuesday, September 4, 2018 at the City Commission meeting.

 

The event organizers have written support from the adjacent property owners. In addition, coordination with Parks and Recreation, Municipal Services & Operations, Police, Fire/Medical, Lawrence Transit, Downtown Lawrence, Inc., Explore Lawrence, and Lawrence Association of Neighborhoods was completed with no issues being identified.
