516 Lyon Street Ordinance Variance Request |
Please include the following item on the City Commission consent agenda for consideration at the September 11, 200 7 meeting:
516 Lyon Street, Sanitary Sewer System Service Connection Crossing of Dedicated Public Right Of Way:
· Approval of the request by Mark Bowden of MP Builders for a variance from 19-214B of the code which states that a private sanitary sewer service line shall not cross any public right-of-way or drainage easement. A private sanitary sewer service line shall not be located in a City public utility easement or City public right-of-way for a length of greater than fifteen (15) feet.
Staff from the Department of Utilities has reviewed, and approve of, the proposed routing of a sanitary sewer service connection to the existing sanitary sewer main located across the Lyon Street Right of Way from 516 Lyon Street. The connection of the infill development consisting of a single-family residential lot in this manner is consistent with the existing residences along Lyon Street. The approval of the variance and waiver of the requirement to extend a public sanitary sewer main to the lot does not limit the future ability of adjacent lots to connect to public sanitary sewer
The approval of a variance to the stated code does not relieve the property owner, or future property owners, of any burden of maintenance, or repair, on the sanitary sewer services (including the length installed in public right of way and/or under paved public streets).
Action Request. Utility Department staff requests approval from the City Commission to grant the requested variance from 19-214 of the code.
