Recommendations/Options/Action Requested:

 

Continue public hearing to consider a vacation request submitted by Larry Wedman to vacate a pedestrian easement designation located within “Tract A” of Landon Court Addition, a minor subdivision in Block One, Westwood Hills.  Staff recommends denying the vacation request.

 

Executive Summary:

Larry Wedman owner of “Tract A” has submitted a vacation application to vacate the pedestrian easement designation within “Tract A” of Landon Court Addition. 

 

A notice was published, and the public hearing was set for the December 5, 2017 City Commission Meeting.  The public hearing was deferred until January 16, 2018 at the request of the Westwood Hills Homeowners Association (HOA). 

 

The applicant and HOA have an agreement for the applicant to deed over the subject Tract after ninety-five percent (95%) of the lots have been sold in the subdivision. The applicant and HOA met on January 6th and agreed to delay action on the item for both parties to further discuss the request.   The HOA Board of Directors provided a written response on January 9th to deny the vacation.

 

Staff recommends denying the Order of Vacation to provide time for additional discussion between the applicant and HOA to reach an agreement.
