Accept the dedication of utility easements by separate instrument on thirteen lots at the Cedar Grove Development in west Lawrence. |

Executive Summary: |
The Cedar Grove Development was platted, and the Governing Body accepted dedication of easements on that plat on February 6, 2018. On the plat, utility easements are located at the rear of the individual lots. However, several utility companies have since changed their procedures regarding the provision of services to certain lots (most notably lots on cul-de-sacs) and wish to serve 13 lots in the Cedar Grove Neighborhood Development from the front of the properties. To accomplish that demand, the developer must, by separate instrument, dedicate to the City utility easements located at the front of those particular lots. Attached are the separate instruments dedicating to the City the necessary utility easements on those 13 lots. The Governing Body must accept all dedications of real property rights to the City, including easements by separate instrument. Accordingly, City Staff recommends that the Governing Body accept the dedication of utility easements by separate instruments on 13 lots at the Cedar Grove Development in west Lawrence. |
