7. Adopt the following ordinance(s) on first reading:
a) Ordinance No. 7928, amending Section 14-304 of the City Code, raising the jurisdictional limit for theft from $500 to $1000. Staff Memo
b) Ordinance No. 7934, allowing the temporary sale, possession, and consumption of cereal malt beverages on the west side of South Park on October 22, 2005 as part of a “Love from Lawrence” fundraiser for victims of Hurricane Katrina. Staff Memo Media Release
8. Adopt the following ordinance(s) on second and final reading:
a) Ordinance No. 7919 [Z-10-50-04]: A request to rezone a tract of land approximately 2.999 acres from A-1 (Suburban Homes Residential) District to RS-1 (Single-Family Residential) District. The property is generally described as being located southeast of Lake Estates Subdivision, between E 920 Road and Lake Alvamar. Submitted by Peridian Group, Inc., for Lake Estates at Alvamar, LLC, property owner of record.
b) Ordinance No. 7920 [Z-10-51A-04]: A request to rezone a tract of land approximately 2.09 acres from A-1 (Suburban Homes Residential) District to RS-1 (Single-Family Residential) District. The property is generally described as being located southeast of Lake Estates Subdivision, between E 920 Road and Lake Alvamar. Submitted by Peridian Group, Inc., for Lake Estates at Alvamar, LLC, property owner of record.
c) Ordinance No. 7921 [Z-10-51B-04]: A request to rezone a tract of land approximately 7.49 acres from A-1 (Suburban Homes Residential) District to RS-2 (Single-Family Residential) District. The property is generally described as being located southeast of Lake Estates Subdivision, between E 920 Road and Lake Alvamar. d) Ordinance No. 7931 [Z-07-44-05] rezoning a tract of land approximately .99 acre from M-1 (Research Industrial) District to RO-2 (Residence-Office) District. The property is generally described as being located between E. 19th and Homewood Streets, east of Bullene Avenue, and commonly known as 927, 931, & 935 Homewood Street, and 934 & 938 E. 19th Street. Initiated by the Lawrence-Douglas County Planning Commission on June 22, 2005. Authorized by the City Commission on September 13, 2005.
e) Ordinance No. 7933, establishing no parking 9:00 a.m. to 3:00 p.m. on school days along both sides of Madeline Lane, between 9th Street and Yale Road.
9. Approve alteration to plat condition regarding building permits for Monterey Bluffs subdivision, north of Peterson Road, west of Monterey Way extended. Staff Memo

C. CITY MANAGER’S REPORT: None.
D. REGULAR AGENDA ITEMS:
1. Receive request for an exception to the building permit moratorium from Greg Seibel to move the house from 1503 Haskell to 1313 Haskell. ACTION: Direct staff, as appropriate.
2. Consider Traffic Safety Commission denial of the request to establish NO PARKING along the west side of Lawrence Avenue from 150 ft. north of Bob Billings Parkway to Applegate Court. Motion carried 4-1-1. Request for No Parking Staff Memo 06/06/05 TSC Minutes Misc. Information
ACTION: Deny request to establish no parking, if appropriate.
3. Consider a motion to recess into executive session for the purpose of: a) consultation with an attorney for the city on matters which would be deemed privileged under the attorney-client relationship; and 2) discussion of possible acquisition of real estate. The justification for the executive session is to keep attorney client matters privileged and to keep possible terms and conditions of possible real estate acquisition confidential at this time. The regular Commission meeting will resume in the Commission meeting room.
ACTION: Approve motion to recess into executive session for 25 minutes, if appropriate.

G. CALENDAR: Meeting List
1. Establish possible date for quarterly joint city/county/usd 497/universities study session.
2. Establish Wednesday, January 4, 2006 as a date for a joint City Commission/Library Board study session.
3. Establish possible date for joint city/county study session regarding rural development regulations.
4. REMINDER – There is a public visioning session regarding the Library Expansion Project scheduled for Monday, October 10 from 7:00 – 9:00 p.m. at the Lawrence Visitor’s Center.
5. REMINDER – There is a study session scheduled for Thursday, October 27 at 9:00 a.m. in the City Commission Room. Topic: Access Management and Street Networks.
6. REMINDER – There is a City Commission goal setting retreat scheduled for December 9 and 10. Location is still to be determined.
7. Future issues for study sessions:

b) Library project study session, suggested date of January 4, 2006

H. CURRENT VACANCIES – BOARDS/COMMISSIONS:
Listed below are existing and upcoming vacancies on City of Lawrence Boards and Commissions. If interested in serving on a board, citizens should send a letter of interest to the Mayor, P.O. Box 708, Lawrence, KS 66044.
Board of Zoning Appeals/Sign Code Board of Appeals:
One position (Santee) will expire September 30, 2005. Mr. Santee is eligible for reappointment to an additional term.
Community Commission on Homelessness:
This is a new board which will consist of eleven members.
Lawrence Alliance:
There is one current vacancy on this board.
Human Relations Commission:
Four positions (Chao, Coleman, Wudarczyk, and Hodison) are due to expire September 30, 2005. Ms. Coleman is completing her final term and is not eligible to be reappointed to an additional term. Ms. Chao, Ms. Wudarczyk, and Mr. Hodison are all eligible for reappointment to additional terms.
Neighborhood Resources Advisory Committee:
(5 members must live in target neighborhoods and 6 at large members)
One vacancy exists for the un-expired position held by Carrie Moore (at-large member). This position expires 09/30/06.
