A.        RECOGNITION/PROCLAMATION/PRESENTATION:

 

1.       Proclaim Tuesday, July 23, 2013, as the City of Lawrence, Kansas Celebration of the 23rd Anniversary of the Americans with Disabilities Act.

 

 

B.        CONSENT AGENDA:

 

NOTE:  All matters listed below on the Consent Agenda are considered under one motion and will be enacted by one motion.  There will be no separate discussion on those items.  If discussion is desired, that item will be removed from the Consent Agenda and will be considered separately.

 

1.       Receive minutes from various boards and commissions:

 

Cultural District Task Force meeting of 06/25/13

Public Health Board meeting of 05/20/13

Sister Cities Advisory Board meeting of 05/08/13

Sustainability Advisory Board meeting of 06/12/13

 

2.       Approve all claims.  The list of approved claims will be posted to the agenda the day after the City Commission meeting.

 

3.       Approve licenses as recommended by the City Clerk’s Office.    

 

4.       Bid and purchase items:

 

a)       Award City Bid No. B1344, PW1334, Farmland, Fence Construction around Above Ground Storage Tanks, to AmeriFence Corporation, in the total amount of $29,242 provided the contractor can meet the terms established in the contract documents.   Bid Memo & Attachments

 

b)       Award City Bid No. B1345, PW1227, Dillons Store #98, Traffic Control, to Vintage Greenmark, Inc., in the total amount of $48,721 provided the contractor can meet the terms established in the contract documents.  Bid Memo & Attachments  

 

c)       Authorize the City Manager to Execute an Engineering Services Agreement, in the amount of $299,000 with Black & Veatch Corporation for Project UT1304 Wakarusa Wastewater Treatment Plant and Conveyance Corridor Facilities.   Staff Memo & Attachments

 

d)       Approve and authorize the City Manager to execute Change Order No. 2 to the construction contract with Garney Companies, Inc. for project UT1206DS O’Connell Road Waterline Extension increasing the contract amount by $81,856 and contract time by 50 calendar days.   Staff Memo & Attachments

 

e)       Authorize the renewal of the City’s annual agreement for Microsoft software maintenance for the period of July 1, 2013 – June 30, 201 to Software House International for $89,264.   Staff Memo

 

5.       Adopt on second and final reading the following ordinances:

 

a)       Ordinance No. 8882, for a Text Amendment (TA-12-00205) to the City of Lawrence Land Development Code, Chapter 20, Article 11, to modify the requirements for a Retail Market Study. Initiated by City Commission on 8/21/12. (PC Agenda Item 6; approved 7-0 on 6/26/13)

 

b)      Ordinance No. 8884, allowing the possession and consumption of alcohol on the 100 block of E 8th Street during Sandbar Birthday Party, August 10, 2013 to August 11, 2013.

 

6.       Adopt the following resolutions:

 

a)       Resolution No. 7034, authorizing the issuance of General Obligation Bonds for certain Main Trafficway Improvements (6th Street and 23rd Street improvements in 2014) in the amount of $325,000.   Staff Memo & Attachments

 

b)       Resolution No. 7035, authorizing $40,000 in general obligation bonds for the improvements at 9th and Kentucky Streets.   Staff Memo & Attachments

 

c)       Resolution No. 7036, authorizing $100,000 in general obligation bonds for the improvements on 9th Street from Emery to Michigan.  Staff Memo & Attachments

 

7.       Approve Site Plan, SP-13-00230, for a sidewalk hospitality area for The Roost, located at 920 Massachusetts Street. Submitted by Mike Myers of Hernly & Associates for Terra Firma LTD, property owners of record.    Staff Report   Site Plan

 

8.       Approve Special Event, SE-13-00269, for a Country Produce tent sale extension at the Discovery Furniture parking lot, 2525 Iowa Street, from August 10 through August 23, 2013. 9.       Authorize the City Manager to execute development agreements for access management improvements at Myers Liquor and Jiffy Lube (located at the northwest corner of 23rd and Alabama Streets) and the proposed redevelopment of 1420 W. 23rd Street, which includes Chipotle and Car Toyz.  Authorize the Mayor to sign Supplemental Agreement No. 3, adding the new projects to the original city/state agreement.   Staff Memo & Attachments

 

10.     Set a due date of Tuesday August 20, 2013 for the Request for Proposal (RFP) for engineering services for the design of stormwater and geometric improvements to the intersection of 23rd Street & Ousdahl Road, Project PW1134.   Staff Memo & Attachments

 

11.     Approve changing the Sister Cities Advisory Board bylaws to clarify the length of term for advisory board members; modify the definition of quorum and clarify the role of friends groups.    Staff Memo & Attachments

 

12.     Approve a Temporary Use of Public Right-of-Way Permit for the Kansas State Fiddling and Picking Championship for the closure of Massachusetts Street between North Park Street and South Park Street on Sunday, August 25, 2013, from 8:00 a.m. – 7:00 p.m.   Staff Memo

ADDRESSING THE COMMISSION:         The public is allowed to speak to any regular agenda item or give public comment after first being recognized by the Mayor.  Individuals are asked to come to the microphone, sign in, and state their name and address.  Speakers should address all comments/questions to the Commission.

1.       Conduct a public hearing regarding the issuance of a Drinking Establishment License for Basil Leaf Café at 616 W. 9th Street and consider granting a distance limitation waiver.   Staff Memo & Attachments

 

ACTION:      Conduct public hearing; find that the proximity of the sale of alcohol by Basil Leaf Café at 616 W. 9th Street is not adverse to the public welfare or safety; and grant a distance limitation waiver, if appropriate.

Consider adopting on first reading, Ordinance No. 8886, approving and appropriating the 2013 City of Lawrence Operating and Capital Improvement Budget, if appropriate.

 

Consider adopting on first reading, Ordinance No. 8887, attesting to the increase in property taxes levied for 2014, if appropriate.

 

Consider adopting on first reading, Ordinance No. 8883, establishing water and sanitary sewer service rates, effective November 15, 2013, if appropriate.

 

Consider approving wholesale water rates, effective November 15, 2013, if appropriate.

1.       Consider canceling the November 12, 2013 City Commission meeting due to the National League of Cities conference, November 12 – 16, 2013.

 

2.       Consider canceling the December 24 and December 31, 2013 City Commission meetings due to the Christmas and New Year Holidays and establishing a City Commission meeting on Monday, December 30 (time to be determined) for year-end items. 

 

·         City Commission meeting scheduled for July 30 canceled due to fifth Tuesday of the month.

 

·         City employee appreciation picnic, Saturday, August 3, 5:00 – 8:00 p.m.  Location:  Broken Arrow Park.

 

·         City Band Concert to commemorate the 150th anniversary of Quantrill’s Raid on Lawrence, Sunday, August 18, 6:30 – 8:00 p.m.  Location:  South Park.

Board of Zoning Appeals/Sign Code Board of Appeals:

Four positions expire 09/30/13.  One position will become vacant and three positions are eligible for reappointment to additional terms.

 

Building Code Board of Appeals:

Four positions expire 11/30/13.  One position will become vacant and three positions will be eligible for reappointment to additional terms.  Eligibility requirements exist for this board.

 

Community Development Advisory Committee:

Two vacancies for positions that expire 09/30/13 and 09/30/15.  Three additional positions expire 09/30/13.  One of those positions will become vacant and three positions will be eligible for reappointment to additional terms.  Eligibility requirements exist for this board.

 

Contractor Licensing Board:

Three positions expire 12/31/13.  Two positions will become vacant and one position is eligible for reappointment to an additional term.  Eligibility requirements exist for this board.

 

Convention & Visitors Bureau Advisory Board:

Four positions will become vacant beginning July 1.  One position expires 07/01/13, one position expires 07/01/14, and two positions expire 07/01/16.

 

Douglas County Senior Services Board:

Two positions expire 12/31/13 and are eligible for reappointment to additional terms.

 

Electrical Code Board of Appeals:

One vacancy for a position that expired 03/31/12.  Eligibility requirements exist for this board.

 

Historic Resources Commission:

One vacancy for a position that expires 03/01/15.  Eligibility requirements exist for this board.

 

Homeless Issues Advisory Committee:

Three positions expire 12/13/13.  One position will become vacant and two positions will be eligible for reappointment to additional terms.

 

Hospital Board:

Two positions expire 09/30/13.

 

Human Relations Commission:

One vacancy on the Advisory Council for a position that expires 09/30/14.

 

Lawrence Alliance:

Two vacancies for positions that expired 11/30/12.  Six additional terms expire 11/30/13 and all are eligible for reappointment to additional terms.

 

Lawrence Citizens Advisory Board:

Two positions expired 03/01/13 and are eligible for reappointment to additional terms.
